1 Scope

This policy applies to information collected through the Site and through email, phone, and text message communications with prospective and current clients. It does not replace the privacy and data handling terms in any signed service agreement between USMD and a client; where those terms differ, the signed agreement controls for the services it covers.

2 Information we collect

Information you provide. When you submit a contact form, request information, book a consultation, or use a calculator, we may collect your name, practice name, email address, phone number, the state or states where you operate, your role, information about your practice such as services offered and patient volume, and anything you choose to include in a message to us.

Consent and opt-in records. If you choose to receive text messages or marketing communications, we record the fact that you opted in, the date and time, the form or channel you used, and the phone number or email address you provided.

Information collected automatically. Like most websites, we collect device and usage information such as IP address, browser type, pages viewed, referring pages, and approximate location derived from IP address, through cookies and similar technologies described in Section 7.

3 How we use information

• To respond to your inquiry and provide the information or consultation you requested.
• To evaluate whether our services are a fit for your practice and to prepare proposals and agreements.
• To onboard and support clients, including compliance documentation and state regulatory updates.
• To send marketing communications, only where you have consented or where otherwise permitted by law.
• To operate, secure, and improve the Site and understand how it is used.
• To comply with legal obligations and enforce our Terms and Conditions.

4 SMS and mobile information

If you opt in to text messages from USMD, we use your mobile number to send the types of messages described in our SMS Terms of Service . You can opt out at any time by replying STOP, and you can get help by replying HELP.

Text messaging originator opt-in data and consent are used solely to deliver the messaging program you signed up for and to honor your opt-out requests.

5 How we share information

We do not sell personal information. Subject to the non-sharing clause in Section 4, we may share information with:

• Service providers that help us operate the Site and our business, such as our CRM and messaging platform, email delivery, scheduling, analytics, hosting, and customer support providers. These providers may use the information only to perform services for us.
• Our physicians and clinical team as needed to evaluate and deliver medical director services to a client practice.
• Professional advisors such as attorneys and accountants, under confidentiality obligations.
• Legal and safety recipients when required by law, subpoena, or court order, or to protect the rights, property, or safety of USMD, our clients, or others.
• A successor in connection with a merger, acquisition, or sale of assets, in which case this policy will continue to apply to your information.

6 Marketing choices

Marketing text messages and marketing emails are sent only to individuals who have expressly opted in. Consent to marketing is never required to submit a form, request information, or purchase any service. You can withdraw consent at any time by replying STOP to any text message, clicking the unsubscribe link in any marketing email, or contacting us at the address in Section 14. If you asked us not to send marketing communications, we will still respond to your inquiry and may contact you about services you have requested.

7 Cookies and analytics

We use cookies, pixels, and similar technologies to keep the Site working, remember your preferences, measure traffic, and understand which pages and campaigns are effective. This may include analytics and advertising tools provided by third parties such as Google and Meta. You can control cookies through your browser settings, and you can opt out of interest-based advertising through the tools those platforms provide. Disabling cookies may affect some Site features.

8 Protected health information

The Site is intended for practice owners and healthcare professionals, not patients. Please do not submit protected health information (PHI) through the Site’s public forms. When USMD handles PHI in the course of providing medical director services to a client practice, that handling is governed by HIPAA, the applicable service agreement, and any Business Associate Agreement in place, not by this policy.

9 Retention and security

We keep personal information for as long as needed to fulfill the purposes described in this policy, to maintain records of consent and opt-out, and to meet legal, accounting, and compliance obligations. Opt-out records are retained so we can honor your request. We use reasonable administrative, technical, and physical safeguards to protect personal information, but no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10 Your rights

Depending on where you live, you may have the right to access, correct, or delete personal information we hold about you, to receive a copy of it, or to object to or restrict certain processing. Oregon residents have rights under the Oregon Consumer Privacy Act, and residents of other states may have similar rights under their state laws. To exercise these rights, contact us using the details in Section 14. We will verify your request and respond within the time required by applicable law. We will not discriminate against you for exercising your rights.

11 Children

The Site is not directed to anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.

12 Third-party sites

The Site may link to third-party websites, scheduling tools, and payment processors. Their privacy practices are governed by their own policies, and we encourage you to review them.

13 Changes to this policy

We may update this Privacy Policy from time to time. The effective date at the top of this page shows when the current version took effect. Material changes will be posted on the Site, and your continued use of the Site after changes are posted constitutes acceptance of the revised policy.
